Following the advert of the Housing Grants, Construction and Regeneration Act 1996 in 1998, adjudication has grown tremendously in popularity with in excess of 1000 adjudications taking place last year. The Act provides amongst other things, that all construction contracts shall provide that any party may call, at any time, for an Adjudicator. The Adjudicator must then decide on the rights of the parties within 28 days. Such decision is binding and may only be overturned, revised or confirmed in Arbitration, litigation or by express agreement.
